Terms of Use (EULA)

1. Acceptance of Terms

By downloading, installing, or using the ChowTracker application ("App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

2. Description of Service

ChowTracker is a nutrition and meal tracking application that allows users to log meals, track nutritional intake, set goals, and monitor progress.

3. Subscription Services

3.1 Subscription Options

ChowTracker offers the following premium subscription options:

• ChowTracker Premium Monthly: £4.99 per month, automatically renews monthly
• ChowTracker Premium Yearly: £34.99 per year, automatically renews annually
• ChowTracker Premium Lifetime: £49.99 one-time payment, never expires

Please note that prices may vary over time and across different regions. The most current pricing information is always available within the App prior to making a purchase.

3.2 App Store Billing

Subscriptions are managed through your Apple App Store account. The following terms apply to subscriptions purchased through the App Store:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Price may vary by location and may be subject to changes. We will notify you of any price changes before they take effect.

3.3 Automatic Renewal

Unless you disable auto-renew, your subscription will automatically renew at the end of each subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.4 Cancellation

You can manage and cancel your subscription at any time through your App Store account settings. Cancellations will take effect at the end of the current billing period.

To cancel, open the Settings app on your iOS device, tap your Apple ID, tap Subscriptions, then tap ChowTracker subscription and select "Cancel Subscription". If you don't see "Cancel Subscription", the subscription is already cancelled and won't renew.

3.5 Refunds

Refund requests are handled by Apple's App Store according to their policies. We do not process refunds directly. To request a refund, please contact Apple Support through the App Store or visit https://support.apple.com/billing.

4. User Account

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to the App
• Copy, modify, or create derivative works of the App
• Use the App in any way that could damage or overburden it

6. Content and Data

6.1 User Content

You retain all rights to the data you input into the App. By using the App, you grant us a non-exclusive license to use, store, and process your data solely to provide and improve the service.

6.2 Data Accuracy

While we strive for accuracy, we do not guarantee the accuracy of nutritional information. The App should not be used as a substitute for professional medical advice.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes through the App or by email. Your continued use of the App following any changes constitutes your acceptance of the modified Terms.

10. Termination

We may terminate or suspend your account and access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

11. Governing Law

These Terms shall be governed by the laws of the United Kingdom, without regard to its conflict of law provisions.
